Acceptance of your Order
Maddocks’ Cakes from Wales Ltd has title to, and owns, the
goods until Property passes to the Buyer in accordance with these
Terms and Conditions of Sale.

a Payment Button’ an E-Mail will be sent to you acknowledging
the exact details of your order. This E-Mail is not an order confirmation
or order acceptance from Maddocks’ Cakes from Wales
Ltd
Order acceptance and the completion of the contract between you
and Maddocks’ Cakes from Wales Ltd will take place when
your order is dispatched, unless you have cancelled the order
in accordance with the Order Cancellation instructions set out
below.
Except for goods that are made to your specifications, we do
not take payment for your goods until the order is ready for dispatch.
Specially ordered goods and goods that are made to your specifications
will be charged for on receipt by us of your order.
Non-acceptance of an order may be a result of one of the following:

as we endeavor to process orders as quickly as we can.

be supplied, are subject to a delay or the price is higher than

you or receive no response to our E-mail, we will continue to process
the remaining items on your order.

it is necessary to substitute
an item, the substitute item

Delivery Information

1. UK Mainland Delivery – Gross Weight up to 1 Kilo:
There is NO CHARGE for postage
and packing on orders sent to
a single UK mainland address.
2. Non UK Mainland Delivery:
- Gross Weight up to 1 Kilo:

Channel Islands, Isle of Man
and the Scottish Isles)
A charge of £4.50 will
be made to cover postage and
packing on orders sent to European
countries outside the UK.
3. UK Mainland / Non
UK Mainland Delivery of Large
/ Bulky Goods – Gross
Weight 1 Kilo and over
Large and bulky goods are subject
to additional carriage charges
and delivery times may vary and
therefore we are unable to quote
a standard delivery charge online
for orders over 1kg.

order is dispatched.
Worldwide Delivery
Delivery times will vary according to destination.
Large and bulky goods are subject to additional carriage charges
and delivery times may vary and therefore we are unable to quote

Delivery
shall be effected by Maddocks’ Cakes from Wales
Ltd in accordance with Incoterms
- Incoterms means the international
rules for the interpretation of trade terms of the International
Chamber of Commerce in force

is made. Unless the context otherwise
requires, any term or expression
which is defined in or given
a particular meaning by the
provisions of Incoterms shall have the same meaning in these
Conditions.
If there is any conflict
between the provisions of
Incoterms and these Conditions, the latter shall prevail.
We reserve the right to withdraw international
delivery at anytime.
Where the Goods are to be
delivered in instalments,
each delivery shall constitute a separate contract and failure by Maddocks’ Cakes
from Wales Ltd to deliver any one or more of the instalments in
accordance with these Conditions
or any claim by the Buyer in respect of any one or more instalments shall
not entitle
the Buyer to treat the
Contract as a whole as repudiated.
If the Buyer fails to take delivery of the Goods or fails to
give Maddocks’ Cakes from Wales Ltd adequate delivery instructions
then, without prejudice to any other right or remedy available,
Maddocks’ Cakes from Wales Ltd may:
- Store the Goods until actual delivery and charge
the Buyer for the reasonable
costs (including insurance) of storage; or,
- Sell the Goods at the best price readily obtainable
and (after deducting all
reasonable storage and selling expenses) account to the
Buyer for the excess over the
Price or,
- Charge the Buyer for any shortfall below the
Price under the Contract.
Import Regulations
International deliveries may be subject to
import controls and other regulations imposed by the Government
of the country of destination specified in your order. Before you
place an order you MUST ensure that there are no Import Regulations
governing or preventing import of the goods into the country of
destination specified in your order.
Any such charges or other loss whatsoever and howsoever caused
as a result of your failure to carry out the necessary checks
must be borne by you as they are entirely beyond the control
of Maddocks’ Cakes from Wales Ltd.
We cannot be held accountable for delays in delivery due to
the exercise of such import controls and other regulations.
Customs
International deliveries may
be subject to import duties and taxes, levied once the products
reach their destination. Any such charges must be borne by you
and are beyond the control of Maddocks’ Cakes from Wales
Ltd. Packages may also be subject to opening and inspection by
local customs officials and therefore Maddocks’ Cakes from
Wales Ltd cannot guarantee the condition in which the package
may arrive. For further information please contact your local
customs office.
We cannot be held accountable
for delays in delivery due
to Customs Clearance.
Risk
Risk of damage to or loss of the Goods shall
pass to the Buyer in accordance with the Incoterm agreed between
the Buyer and Maddocks ’ Cakes from Wales Ltd.

a quality service. In the unlikely event that you are not entirely
satisfied with your order, the statements that follow explain what
